Terms and Conditions

These Terms and Conditions (T&Cs) govern the agreement between SOLA Pergolas Ltd, whose registered trading address 85 Great Portland Street, London, W1W 7JT ("the Company", "we", "us", or "our") and the customer ("you" or "the Client") in relation to the supply and/or installation of pergola structures.

By placing an order and signing these Terms and Conditions, the Client agrees to be legally bound by them.

1. Orders and Payment
1.1 All pergola orders must be paid in full at the time of order. All prices quoted include VAT at 20%.
1.2 Orders are only processed once payment has cleared and a signed order confirmation and terms and conditions, is received. Any delay in payment or approval may affect lead times.

2. Lead Times and Delivery
2.1 Typical lead times are 8-12 weeks from order confirmation and subject to structure size and technical specification. However, during peak periods or in the event of global shipping or customs delays, lead times may extend.
2.2 We will provide estimated timelines in good faith, but they are not guaranteed. We accept no liability for delays outside our reasonable control.

3. Site Survey and Access
3.1 A site survey by a SOLA Pergolas Ltd team member is mandatory prior to any installation to determine any special requirements or considerations during the pergola installation.
3.2 While no preparation by the Client is necessary, any required electrical work must be completed prior to installation.
3.3 If the site has restricted access or lifting requirements, we can arrange appropriate equipment such as cranes or lifts, which will be quoted separately and invoiced additionally.

4. Installation
4.1 SOLA Pergolas Ltd offers both supply-only and supply-and-installation services. Installation is performed by experienced, trained professionals and is covered under warranty for 12 months from the date of installation.
4.2 It is the Client’s responsibility to ensure access and working conditions are suitable on the agreed installation date. Should the client make a last minute change to the installation date, SOLA Pergolas Ltd, in some extreme cases where longer distances or overnight accommodation is required (Scotland, Cornwall & Central London), may charge an additional fee for last minute appointment changes.
4.3 It is the clients responsibility to ensure a suitable sub-base is situated under where the pergola is to be bolted down to. This, ideally, needs to be a solid concrete pad, located where the legs will go, or at the very least a full bed of mortar with no voids under the paving. For pergolas going onto decking, additional timber or composite reinforcement under the deck boards will be required as the structure cannot solely be attached to the deck boards alone. Any damage caused by our installers to decking or paving as a result of lack of suitable sub-base shall be the responsibility of the client and not the company.
4.4 A disclaimer will need to be signed prior to the pergola being bolted down into the ground. Should the client not be prepared to sign the necessary disclaimer, the pergola shall not be bolted down by our team and the client will need to arrange an alternative option to get the pergola fixed down to the ground.
4.5 The installation team remain responsible for the condition of the pergola whilst under their care and control during the day of delivery and installation. Photos will be taken upon completion to confirm everything was left in perfect condition before they leave.

5. Cancellations, Refunds and Ownership
5.1 Once an order has been signed off and manufacturing has begun, only 50% of the original invoice amount is refundable.
5.2 Once the pergola has been manufactured fully and has left the factory, no refunds are permitted. At this point, the pergola becomes the full property of the Client, however, responsibility for the safe arrival of the product remains with the shipping company (outside of the UK) and/or SOLA Pergolas Ltd (within the UK) until receipt of the goods at the clients address.
5.3 In exceptional cases, SOLA Pergolas Ltd may, at its sole discretion, offer to purchase the pergola at a discounted rate for use as stock, should the client no longer want the bespoke pergola. This is not an obligation and cannot be guaranteed and will be assessed on a case-by-case basis.
5.4 Should your order take longer than 20 weeks from dimensions sign off, to be delivered, we will authorise a cancellation and full refund based solely on manufacturer negligence, exclusions to this clause are shown in 5.4.1
5.4.1 Exclusions to the cancellation terms include natural disasters, political events and conflicts where usual routes of delivery have to be circumnavigated or extended. Should your order be affected by any of the elements in this clause, clause 5.3 will come into effect where we will try and come to a resolution with the customer to agree fair cancellation terms for both parties. Should no agreement be reached then clause 5.1 comes into effect and the pergola becomes the property of SOLA Pergolas Ltd.

6. Warranties
6.1 SOLA Pergolas are supplied with the following manufacturer warranties: Lite – 5 years Pro – 10 years Luxe – 10 years Sky – 7 years
6.2 Installation workmanship is warranted for 12 months.
6.3 Warranty coverage excludes any damage caused by extreme weather, including windstorms or heavy snow. It is essential that the pergola roof be left fully open and side screens raised during storms or high winds to prevent damage. Failure to follow this guidance may invalidate the warranty.
6.4 All SOLA pergola models must be secured down to the ground to ensure no movement or damage during high winds and extreme storms, should a client not have the pergola bolted down for any reason, this will invalidate any warranty claims.

7. Maintenance and Customer Responsibility
7.1 SOLA Pergolas are low-maintenance products and require no regular servicing.

Only use warm soapy water to clean your pergola, any damage caused as a result of contact with acidic or abrasive cleaning products will not be covered under warranty.

8. Spare Parts & Replacement Parts
8.1 SOLA Pergolas keep small amounts of spare parts in stock such as motors, LED lighting, transformers and fixtures and fittings. Larger elements such as louvers, legs and beams, when required will need to be ordered from the factory and may incur similar lead times as the original order. By signing this agreement, you are acknowledging you are ordering a bespoke product and as such extended lead times may be possible for spare parts.

9. RAL Colour Variations
9.1 Slight RAL colour tone differences may occur between different manufacturers, coatings, or accessory components. We guarantee that our pergola components will be painted the same RAL colour but we cannot guarantee that, for example, our RAL 7016 matches RAL 7016 from a different manufacturer.
